Terms of Service

These Terms of Service ("Terms") govern your use of FieldCalc Pro ("the App"), developed and published by Bytecove Software ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple device that you own or control, subject to the Apple Media Services Terms and Conditions. This license does not allow you to distribute, sublicense, or make the App available over a network where it could be used by multiple devices at the same time.

2. Description of Service

FieldCalc Pro provides trade-specific calculators for electrical, HVAC, and construction professionals. The App includes both free and subscription-based features. The App operates entirely offline and stores all data locally on your device.

3. Professional Disclaimer

The calculations, results, and reference data provided by the App are intended for estimation and reference purposes only. While we strive for accuracy, all results should be verified by a qualified professional and checked against applicable local codes and standards before being used for any construction, installation, or engineering work.

You acknowledge and agree that:

• The App is not a substitute for professional engineering judgment
• All calculations should be verified with your local Authority Having Jurisdiction (AHJ)
• Code references (NEC, ASHRAE, IRC, ACI) are provided for convenience and may not reflect the most current edition or local amendments
• We are not responsible for any damages, injuries, or losses arising from reliance on the App's calculations

4. Subscriptions

FieldCalc Pro offers auto-renewing subscription plans:

• Monthly: $9.99 per month
• Yearly: $99.99 per year

Subscriptions are billed through your Apple ID and are subject to Apple's subscription terms. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel your subscriptions in your Apple ID account settings.

5. Free Tier

The App includes a free tier that provides access to 9 calculators (3 per trade), 1 project, and basic functionality. No subscription is required to use the free tier.

6. Intellectual Property

The App and all of its content, features, and functionality, including but not limited to calculator logic, design, text, and graphics, are owned by Bytecove Software and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.

7. User Data

All data you create within the App, including projects, calculations, and preferences, is stored locally on your device. We do not collect, transmit, or store your data on any server. You are responsible for backing up your device to preserve your data. If you delete the App, all associated data will be permanently deleted.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Bytecove Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of the App, regardless of the cause of action or theory of liability.

In no event shall our total liability exceed the amount you have paid for the App in the twelve (12) months immediately preceding the event giving rise to the claim.

9. Warranty Disclaimer

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

10. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your license to use the App is revoked.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the App after any changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
